Uber & Lyft Accidents Injured in Texas? Work With Attorneys Who Can Win Your Case

Uber & Lyft Accident Lawyer in Sugar Land

Triple Board Certified Representation for Sugar Land Rideshare Crash Victims

Uber and Lyft accident claims can depend on details that don’t arise in an ordinary car accident, particularly the driver’s rideshare app status and the insurance policies in effect. The West Law Firm represents injured victims and their families in personal injury matters, including passengers, motorists, pedestrians, and cyclists hurt in rideshare crashes.

S. Scott West is Triple Board Certified in Personal Injury Trial Law. He routinely visits accident scenes and conducts inspections as part of our case approach. We examine the parties, available insurance coverage, crash evidence, and injury documentation to determine how a claim may proceed.

Who May Be Responsible for a Rideshare Accident?

Responsibility depends on how the collision happened and each party’s conduct. A potentially responsible party may be the rideshare driver, another motorist, or a party connected to a dangerous road condition or defective vehicle component. The evidence must support liability before fault can be assigned.

The injured person’s role also affects the analysis. A rideshare passenger may have access to coverage associated with an active trip, while a pedestrian, cyclist, or occupant of another vehicle may face different questions about fault and applicable policies.

Texas follows proportionate responsibility rules. Compensation can be reduced by the injured person’s percentage of fault, and someone found 51% or more responsible is generally barred from recovering damages. Statements, photographs, witness accounts, and other evidence can therefore matter when insurers dispute responsibility.

Texas Insurance Coverage for Uber & Lyft Accidents

Texas regulates transportation network companies, including Uber and Lyft, under Chapter 2402 of the Texas Occupations Code. Chapter 1954 of the Texas Insurance Code establishes insurance requirements that change depending on whether the driver was offline, awaiting a request, or completing a prearranged ride.

When the Driver Is Offline
The driver’s personal auto policy generally applies when the rideshare platform is off. Texas minimum personal-policy limits are $30,000 for each injured person and $60,000 for each accident involving bodily injury, plus $25,000 for property damage.

When the Driver Is Waiting for a Request
When the driver is logged on but hasn’t accepted a request, Section 1954.052 requires contingent liability coverage if the personal policy denies coverage or is insufficient. The minimum limits are $50,000 for each person and $100,000 for each accident involving bodily injury, plus $25,000 for property damage.

From Ride Acceptance Through Drop-Off
Section 1954.053 requires $1 million in total liability coverage from the time a driver accepts a ride through the passenger’s drop-off. This active-trip coverage applies to an incident involving death, bodily injury, or property damage. The same provision requires uninsured and underinsured motorist coverage during this period.

Personal auto policies may exclude coverage while a driver is logged into a rideshare platform or completing a prearranged ride under Section 1954.151. The injured person’s uninsured and underinsured motorist coverage may also require review. Auto insurers must offer that coverage in Texas, and Section 1952.101 requires a written rejection for it to be validly declined.

Evidence in a Sugar Land Rideshare Accident Claim

A rideshare accident lawyer in Sugar Land must determine how the crash happened and which insurance period applied. Physical evidence can provide context for roadway conditions, sight lines, vehicle positions, and other details relevant to the collision.

Important records may include:

  • Crash reports, scene photographs, and witness information
  • Vehicle damage and repair records
  • Medical records and bills documenting the injuries
  • Wage and employment records supporting lost-income claims
  • GPS data, trip details, driver login records, and app communications

Digital records can show whether the driver was offline, waiting for a request, traveling to collect a passenger, or transporting one. Prompt preservation reduces the chance that relevant digital or physical information will be overwritten, discarded, or otherwise lost.

Compensation & Filing Deadlines

Compensation in a rideshare injury claim can include medical expenses, lost income, pain and suffering, and other losses supported by the evidence. The amount available depends on the severity of the injuries, documented financial losses, responsibility for the crash, and applicable insurance limits. No reliable value can be assigned without reviewing those details.

Texas Civil Practice and Remedies Code Section 16.003(a) generally allows two years from the date a personal injury cause of action accrues to file a lawsuit. A shorter procedural requirement may apply when a government entity is involved. Section 101.101 generally requires written notice within six months, separate from the deadline for filing suit.

Venue, meaning the proper location for a lawsuit, depends on the parties and events connected to the claim. Cases arising from Sugar Land crashes may proceed in Fort Bend County courts when the legal venue requirements are met.

What to Expect During a Rideshare Accident Claim

A claim generally begins with a review of the collision, injuries, available records, and possible insurance coverage. Identifying the driver’s status is essential because it can determine which personal, contingent, or active-trip policy requires examination.

We may collect crash evidence, identify responsible parties, review policy terms, and document medical and financial losses. The claim may then proceed through insurance negotiations. If the parties don’t reach a resolution, litigation may be necessary in the appropriate court.
